Right of withdrawal

In accordance with the legal provisions in force, the CLIENT has the right to withdraw from the purchase without any penalty and without specifying the reason within 14 days from the date of receipt of the products.
Any such CLIENT who intends to exercise the right of withdrawal must communicate this to MIDARTE through an explicit declaration, which can be sent by registered mail or by e-mail.
The CLIENT may exercise the right of withdrawal also by sending any explicit declaration containing the decision to withdraw from the contract or alternatively transmit the standard withdrawal form, as per Attachment I, part B, Legislative Decree 21/2014 (not mandatory) whose text is shown below:

In case of exercising the right of withdrawal, the CLIENT is required to return the goods within 14 days from the day on which he/she informed MIDARTE of his/her wish to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005. Shipping costs will be borne by the CLIENT

The goods must be returned intact, in the original packaging, complete in all parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.) and complete with the attached fiscal documentation. Without prejudice to the right to verify compliance with the above, MIDARTE will reimburse the value of the products subject to withdrawal within a maximum period of 14 days from receipt of the notice of withdrawal.
MIDARTE however reserves the right to suspend reimbursement until the goods are received or until the CLIENT proves to have returned the goods to MIDARTE, pursuant to art. 56 paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.
MIDARTE will reimburse using the same payment method chosen by the CLIENT at the time of purchase.

Diritto di recesso

Conformemente alle disposizioni legali in vigore, il CLIENTE ha diritto di recedere dall'acquisto senza alcuna penalità e senza specificarne il motivo, entro il termine di 14 giorni decorrenti dalla data di ricezione dei prodotti.
Il CLIENTE che intende esercitare il diritto di recesso dovrà comunicarlo a MIDARTE tramite dichiarazione esplicita, che potrà essere trasmessa a mezzo raccomandata a.r. oppure via e-mail.
Il CLIENTE potrà esercitare il diritto di recesso anche inviando una qualsiasi dichiarazione esplicita contenente la decisione di recedere dal contratto oppure alternativamente trasmettere il modulo di recesso tipo, di cui all'Allegato I, parte B, D.Lgs 21/2014 (non obbligatorio) il cui testo viene di seguito riportato:

In caso di esercizio del diritto di recesso, il CLIENTE è tenuto a restituire i beni entro 14 giorni dal giorno in cui ha comunicato a MIDARTE la propria volontà di recedere dal contratto ai sensi dell'art. 57 del D.lgs 206/2005.I costi della spedizione saranno sostenuti dal CLIENTE

La merce dovrà essere restituita integra, nella confezione originale, completa in tutte le sue parti (compresi imballo ed eventuale documentazione e dotazione accessoria: manuali, cavi, ecc.) e completo della documentazione fiscale annessa. Fatta salva la facoltà di verificare il rispetto di quanto sopra, MIDARTE provvederà a rimborsare l'importo dei prodotti oggetto del recesso entro un termine massimo di 14 giorni dal ricevimento della comunicazione di recesso.
MIDARTE, tuttavia, si riserva la facoltà di sospendere il rimborso fino al ricevimento dei beni oppure fino al momento in cui il CLIENTE dimostri di aver rispedito i beni a MIDARTE, ai sensi dell’art. 56 comma 3 del D.Lgs 206/2005, modificato dal D.lgs 21/2014
MIDARTE eseguirà il rimborso utilizzando lo stesso mezzo di pagamento scelto dal CLIENTE in fase di acquisto.
